1. Overview

These Terms of Service (“Terms”) govern your access to and use of the NeverAge website, online store, mobile interfaces, and related services (collectively, the “Services”). “NeverAge,” “we,” “us,” and “our” refer to NeverAge, LLC.

By accessing or using the Services—including browsing the website, creating an account, or purchasing products—you agree to be bound by these Terms, our Privacy Policy [LINK], and our Refund Policy [LINK]. If you do not agree, you must discontinue use of the Services.

The Services are hosted and powered by Shopify Inc., which provides ecommerce infrastructure and payment processing support.

2. Eligibility, Accounts & User Responsibilities

2.1 Eligibility

By using the Services, you represent and warrant that:

  • You are at least the age of majority in your state of residence.
  • You have the legal capacity to enter into these Terms.
  • You will use the Services only in accordance with these Terms and applicable law.

2.2 Account Information

You agree to provide accurate, current, and complete information at all times and to update such information when necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

We may suspend or terminate your account if we suspect fraudulent, deceptive, abusive, or unlawful conduct.

3. Product Descriptions, Health Information & Scientific Content

3.1 Product Descriptions

We aim to present accurate product descriptions; however:

  • Appearance, color, and packaging may vary.
  • We do not guarantee that descriptions or content are error-free, complete, or current.

3.2 No Medical Advice

All information (including product descriptions, FAQs, blog content, scientific summaries, marketing materials, emails, and customer service communications) is provided for general informational purposes only and does not constitute medical advice or establish a healthcare-provider relationship.

3.3 Scientific Studies, Published Research & Representations

The Services may reference scientific studies or third-party research related to creatine or dietary supplements. Any summaries, interpretations, or descriptions are provided for educational context only.

You acknowledge and agree that:

  • NeverAge does not warrant the accuracy, applicability, completeness, or interpretation of any scientific information.
  • Published studies may have limitations, may not be representative, and may not apply to your individual situation.
  • Results described in any study or promotional materials are not guaranteed and may vary significantly from person to person.
  • You will not rely on such information as a promise, guarantee, or representation of specific outcomes.

3.4 No Guarantees of Results

We do not guarantee that you will experience any particular effect or benefit from using our products. Individual results vary based on numerous factors.

3.5 FDA Disclosure

Statements regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration.

Products are not intended to diagnose, treat, cure, or prevent any disease.

4. Orders, Acceptance & Usage Restrictions

Your order constitutes an offer to purchase. We may accept or reject orders for any reason, including suspected fraud, supply issues, or policy violations. Acceptance occurs only once payment is processed and you receive an order confirmation.

Products are intended solely for personal, non-commercial use, and you may not resell or redistribute them without written authorization.

5. Pricing, Promotions & Billing

Prices are in U.S. dollars and may change without notice. The price charged is the price displayed at checkout at the moment you place the order.

Taxes, shipping, and handling fees will be added where applicable. You authorize NeverAge and Shopify to charge your payment method for all amounts due.

Promotions may be subject to additional terms and may not be combined unless expressly stated.

6. Shipping, Delivery & Risk of Loss

Shipping timelines are estimates and not guarantees. Once a product is transferred to the carrier:

  • Title and risk of loss pass to you, and
  • NeverAge is not responsible for carrier delays, lost packages, or theft following delivery.

7. Refunds, Returns & Cancellations

All returns and refunds are governed by our Refund Policy [LINK].

Our gummies are consumable products, and for safety and quality control, returns and exchanges are not accepted, even if unopened.

If a product arrives damaged or incorrect, you must contact us within the timeframe stated in the Refund Policy.

8. Intellectual Property

All content on the Services—including trademarks, logos, product images, designs, videos, graphics, text, and compilations—is owned by NeverAge or its licensors and protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial purposes only. All unauthorized uses are prohibited.

9. Optional Tools & Third-Party Services

Third-party tools, apps, integrations, or services may be available through the Services. These are provided “as is” and “as available” without warranties. Your use of these tools is entirely at your own risk.

10. Third-Party Links

The Services may contain links to third-party websites. NeverAge does not endorse or control such websites and is not responsible for their content, practices, or products.

Your interactions with any third-party site are solely between you and the third party.

11. Relationship with Shopify

Shopify facilitates ecommerce operations but is not a party to any transaction between you and NeverAge.

You expressly release Shopify from any claim arising from or related to your purchases from NeverAge.

12. Privacy & Communications Consent (Email, SMS, etc.)

12.1 Privacy Policy

Your use of the Services is subject to our Privacy Policy [LINK], which explains how we collect, process, and protect your personal information.

12.2 Communications Consent (TCPA-Compliant)

By providing your email address or phone number, you consent to receive:

  • Transactional communications (order confirmations, updates, notices)
  • Customer service communications
  • Marketing emails or SMS messages, if you opt-in

You may opt out of marketing communications at any time.

Consent to receive marketing messages is not a condition of purchase.

13. Feedback, Reviews & User Content

Any content you submit—including reviews, ideas, suggestions, or other Feedback—grants NeverAge a perpetual, worldwide, royalty-free, irrevocable, sublicensable license to use such content for any purpose.

You represent that you own the rights to such content and it does not violate any laws or third-party rights.

We may remove content violating these Terms.

14. Errors, Inaccuracies & Corrections

We reserve the right to correct any errors, inaccuracies, omissions, or pricing mistakes and to cancel orders affected by such issues.

15. Prohibited Conduct

You agree not to use the Services to:

  • Violate any law
  • Engage in fraudulent or harmful behavior
  • Interfere with security features
  • Scrape or data-mine content
  • Transmit malware
  • Resell products without authorization
  • Provide false information

We may suspend access for violations.

16. No Professional Relationship

Your use of the Services does not create a doctor-patient, nutritionist-client, or other professional relationship. No content on the Services should be relied upon as professional guidance.

17. Disclaimer of Warranties

To the fullest extent permitted by law:

The Services and all products are provided “AS IS” and “AS AVAILABLE”, without any warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness
  • Expected results or outcomes

We do not guarantee that:

  • Services will be uninterrupted or error-free
  • Results suggested by studies or marketing materials will occur
  • Product information is complete or current

18. Limitation of Liability

To the fullest extent permitted by law:

NeverAge, its officers, employees, affiliates, agents, and Shopify shall not be liable for:

  • Indirect, incidental, punitive, or consequential damages
  • Lost profits or revenues
  • Personal injury or product misuse
  • Reliance on scientific, health, or product information
  • Inaccuracies or errors in product descriptions

In all events, our total liability shall not exceed the amount you paid for the product giving rise to the claim during the previous six (6) months.

Some jurisdictions do not allow certain limitations; those limitations apply to the maximum allowable extent.

19. Indemnification

You agree to indemnify and hold harmless NeverAge, Shopify, and their respective officers, employees, and affiliates from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising out of:

  • Your use of the Services or products
  • Your reliance on product or scientific information
  • Your breach of these Terms
  • Your violation of law or third-party rights

20. Limitation on Time to Bring Claims

To the fullest extent permitted by law, any claim or cause of action arising out of or related to the Services or products must be filed within one (1) year of the event giving rise to the claim.

Claims filed after this period are permanently barred.

21. Binding Arbitration, Jury Trial Waiver & Class Action Waiver

21.1 Mandatory Arbitration

Except for claims that may be brought in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the products shall be resolved exclusively through binding arbitration under the Federal Arbitration Act (FAA).

Arbitration shall be conducted on an individual basis by a neutral arbitrator.

21.2 Class Action and Collective Action Waiver

You agree that:

  • No class or collective actions are permitted,
  • You may only bring claims in your individual capacity, and
  • The arbitrator has no authority to consolidate claims or issue class-wide relief.

21.3 Jury Trial Waiver

If any claim proceeds in court rather than arbitration, you waive the right to a jury trial.

21.4 Venue for Non-Arbitrable Claims

For disputes not subject to arbitration, the exclusive venue shall be the state or federal courts located in Denver, Colorado.

22. Severability

If any provision of these Terms is found invalid or unenforceable, it shall be enforced to the maximum extent permitted, and the remainder shall remain fully enforceable.

23. No Waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other rights.

24. Changes to Terms

We may modify these Terms at any time. The updated Terms will be posted on the website and become effective when posted. Your continued use of the Services constitutes acceptance of the revised Terms.
